What Is Overstay in Thailand?
Overstaying your visa in Thailand means remaining in the country after your permission to stay has expired — the date stamped in your passport by immigration when you entered, not the expiry date on your visa sticker. Thailand treats visa overstay as a criminal offense under Section 81 of the Immigration Act B.E. 2522. Enforcement has consistently increased since 2022, with immigration officers conducting routine checks at hotels, accommodation, and border crossings.
The immediate consequences are automatic and non-negotiable: a daily fine of ฿500 per day, up to a maximum of ฿20,000 — plus potential re-entry bans lasting 1 to 10 years. If you are arrested rather than surrendering voluntarily, consequences are significantly worse. The best protection is extending your visa before it expires — a tourist extension costs ฿1,900 and is processed same-day at any immigration office. Long-stay visa holders also need to ensure they have a valid re-entry permit before any international travel — exiting without one cancels your visa regardless of its remaining validity. If you are a long-stay holder on retirement or marriage visa, your 90-day reporting obligation runs independently — missing it adds a separate ฿2,000 fine on top of any overstay penalties.

How to Fix an Overstay Situation
If you realise you have overstayed, act immediately. Every additional day adds ฿500 to your fine (up to the ฿20,000 cap).

Go to Immigration Immediately
Visit your nearest Thai immigration office. Bring your passport. Tell the officer you have overstayed and wish to surrender voluntarily.
Prepare Your Documents
Bring: original passport, photocopies of your passport photo page and entry stamp, and sufficient cash (max ฿20,000 THB) for the fine.
Pay the Fine
The officer calculates your fine (฿500 × days overstayed, max ฿20,000). Pay in Thai baht cash. You will receive a receipt. Keep it.
Book Your Departure
Unless your situation is resolved in-country (rare), you will need to exit Thailand. Book a flight and depart within the timeframe specified.
Apply for a New Visa Abroad
Once outside Thailand, apply for the correct visa at a Thai embassy. Do not attempt to re-enter if you have a ban recorded.
